Terms of Service

These Terms of Service and Terms of Use ("Terms") are a binding agreement between you and MyAdvocAI ("MyAdvocAI," "we," "us," or "our"). They govern your access to and use of our website, forms, text messaging programs, support channels, informational content, and related services (collectively, the "Services"). By accessing or using the Services, you agree to these Terms. If you do not agree, you must not use the Services.
If you use the Services for another person, or provide us with information about another person, you represent that you have authority to do so and to accept these Terms on that person’s behalf to the extent legally permitted.
1. Eligibility and Service Scope
The Services are designed to support healthcare follow-through, communication, reminders, coordination, and general informational guidance. The Services are not emergency services, not a replacement for licensed medical care, and not a guarantee that any appointment, reminder, or recommendation will be delivered, acted upon, or medically appropriate for your specific circumstances.
2. No Medical Advice; No Emergency Use
MyAdvocAI does not practice medicine, diagnose conditions, prescribe treatment, provide emergency intervention, or create a physician-patient or similar clinical relationship through the Services. If you believe you or someone else may be experiencing a medical emergency, call 911 immediately or contact the appropriate emergency provider. Do not rely on the Services for urgent or time-sensitive matters.
3. SMS Consent, Delivery, and Opt-Out
By providing a phone number and using SMS-enabled features, you authorize us and our service providers to send service-related text messages, including onboarding, reminders, support notices, updates, and follow-through messages. Message frequency may vary. Message and data rates may apply. You are responsible for providing a current number you are authorized to use and for telling us if that number changes or is reassigned.
You may opt out of many non-essential text messages by following the instructions in the message, including replying STOP where available. Even after an opt-out, we may send limited legally permitted transactional or security-related communications where applicable.
4. Your Responsibilities
You agree to provide accurate information, use the Services lawfully, maintain the security of your devices and communication channels, and obtain any permissions needed before submitting another person’s contact or health-related information. You may not misuse the Services, interfere with platform security, upload harmful code, impersonate another person, harvest data, or use the Services to violate law or third-party rights.
5. Submitted Information and License
You retain ownership of information you submit, but you grant MyAdvocAI a non-exclusive, worldwide, royalty-free license to host, store, process, transmit, and use that information as needed to operate, maintain, secure, improve, and support the Services; document consent and support history; comply with law; and enforce our rights. You represent that you have all rights needed to submit that information.
6. Privacy and Security
Your use of the Services is also subject to our Privacy Policy. We use reasonable safeguards designed to protect information, but no website, cloud system, or SMS channel is completely secure. Because messages may appear on lock screens, shared devices, backups, or carrier systems, you should be careful about what information you choose to send through text messaging.
7. Third-Party Providers
The Services may depend on third-party hosts, software providers, telecom vendors, messaging platforms, analytics tools, and infrastructure partners. We are not responsible for outages, delivery failures, delays, filtering, or independent acts or omissions of those third parties except to the extent required by law.
8. Intellectual Property
The Services, including branding, site design, software, workflows, text, and original content provided by MyAdvocAI, are owned by or licensed to us and protected by applicable intellectual property laws. Except for the limited right to use the Services in accordance with these Terms, no rights are granted to you.
9. Suspension and Termination
We may suspend, limit, or terminate access to the Services at any time if we believe doing so is necessary to protect users, comply with law, address misuse, respond to security concerns, or manage operations. You may stop using the Services at any time.
10. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND ANY WARRANTY THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, TIMELY, OR ERROR-FREE.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYADVOCAI AND ITS AFFILIATES, OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, REVENUE, GOODWILL, BUSINESS INTERRUPTION, PERSONAL INJURY, OR WRONGFUL DEATH ARISING OUT OF OR RELATED TO THE SERVICES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF US $100 OR THE AMOUNT YOU PAID US FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM IN THE THREE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
12. Indemnification
You agree to defend, indemnify, and hold harmless MyAdvocAI and its affiliates, owners, personnel, contractors, licensors, and service providers from and against claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to your use of the Services, your violation of these Terms or law, your submitted content, or your violation of another person’s rights.
13. Disputes, Arbitration, and Class Action Waiver
To the fullest extent permitted by law, disputes relating to the Services or these Terms should first be submitted to us in writing for informal resolution. If not resolved, either party may elect binding individual arbitration, except for eligible small-claims matters and claims seeking injunctive relief for intellectual property misuse, confidentiality breaches, or unauthorized access. You and MyAdvocAI waive any right to participate in a class action, collective action, representative action, or jury trial to the extent permitted by law.
14. Governing Law
These Terms are governed by the laws of the Commonwealth of Pennsylvania and applicable United States federal law, without regard to conflict-of-law principles, except where mandatory consumer protection law requires otherwise.
15. Changes to the Terms
We may update these Terms at any time. Updated Terms become effective when posted unless a later date is stated. Your continued use of the Services after the effective date of updated Terms constitutes acceptance of the revised Terms.
